Inmates File Suit Stating Strip Search is Violation of Constitutional Rights

Congratulations to Bailey & Wyant partner David J. Mincer, who recently successfully argued before the U.S. Court of Appeals for the Fourth Circuit in Richmond, Virginia, which affirmed a District Court Order granting the West Virginia Regional Jail Authority summary judgment on a proposed class action case brought by attorneys from NY, PA, OH, and Washington, D.C. on behalf of all West Virginia jail detainees. Said detainees challenged the constitutionality of the Jail Authority’s strip search and delousing policy.

Summary Judgement Won Before the United States District Court for the Northern District Of West Virginia

John Fuller and Michael Taylor won summary judgment on behalf of an insurance company before the United States District Court for the Northern District of West Virginia in a coverage dispute declaratory judgment action. The insured, a real estate developer, had prepped a site for the construction of a big box store for a tenant. After the store had been constructed defects were found in the building and alleged to have been caused by negligent site prep work.
